By registering with North East Wisconsin Riders Inc.,
or by participating in, or observing, any ATV Activity of North East Wisconsin Riders
Inc. you hereby agree that you are aware that ATV Activities maybe hazardous and
involve possible risks, dangers, and may result in personal injury. Further, you
hereby accept and acknowledge the risks and hazards inherent to ATV Activities including,
but not limited to: accidents which occur during transportation or travel to and
from the ATV Activity departure and/or arrival sites, overturning or upsetting of
an ATV; falling from an ATV, impact or collision with rocks, trees, logs, fences,
water, deadfall or other obstacles on and off trails, variations in terrain, limited
visibility, rapidly changing weather, other motorized vehicles and equipment, encounters
with domestic or wild animals, being struck by objects thrown by an ATV, negligence
of other riders, negligence of other parties participating in any sponsored, coordinated
or offered North East Wisconsin Riders Inc. activity, and NEGLIGENCE ON THE PART
OF NORTH EAST WISCONSIN RIDERS INC., THE EVENT ORGANIZERS, ANY MEMBER OF NORTH EAST
WISCONSIN RIDERS INC. OR THE PROPERTY OWNER TO SAFEGUARD AND PROTECT YOU FROM THE
RISKS, DANGERS AND HAZARDS OF ATV ACTIVITIES. YOU FREELY ACCEPT AND FULLY ASSUME
ALL RISKS, DANGERS AND HAZARDS ASSOCIATED WITH ATV ACTIVITIES AND THE POSSIBILITY
OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND/OR LOSS RESULTING THERE FROM.
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY
AGREEMENT
By registering with North East Wisconsin Riders Inc, or
by participating in, or observing ATV Activities, or by accessing any property or
land where ATV Activities are taking place you hereby agrees to:
WAIVE ANY AND ALL CLAIMS that you have or may have in the future against NORTH EAST
WISCONSIN RIDERS INC. OR ANY PREMISE OR PROPERTY OWNER OR EVENT ORGANIZER, THEIR
DIRECTORS, OFFICERS, VOLUNTEERS, PARTNERS, SPONSORS, EMPLOYEES, AGENTS, GUIDES,
INSTRUCTORS, INDEPENDENT CONTRACTORS, MEMBERS, ORGANIZERS, SUBCONTRACTORS, AND REPRESENTATIVES
(all of whom are hereinafter referred to as the "RELEASEES") AND TO RELEASE THE
RELEASEES FROM ANY AND ALL LIABILITY FOR ANY LOSS, DAMAGE, EXPENSE OR INJURY INCLUDING
DEATH THAT YOU MAY SUFFER OR THAT YOUR NEXT OF KIN, GUESTS OR INVITEES MAY SUFFER
AS A RESULT OF PARTICIPATION IN, OR OBSERVATION OF, ATV ACTIVITIES, DUE TO ANY CAUSE
WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY
OR OTHER DUTY OF CARE, INCLUDING FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD
OR PROTECT THE UNDERSIGNED FROM THE RISKS, DANGERS AND HAZARDS OF THE ATV ACTIVITIES.
HOLD HARMLESS AND INDEMNIFY THE RELEASEES FROM ANY AND ALL LIABILITY FOR ANY PROPERTY
DAMAGE OR PERSONAL INJURY TO YOU OR ANY THIRD PARTY RESULTING FROM YOU PARTICIPATION
IN, OR OBSERVATION OF, ATV ACTIVITIES
GOVERNING LAW and REPRESENTATIONS
By registering with North East Wisconsin Riders Inc., or by participating in, or
by observing ATV Activities, you hereby agree that you are not relying on any oral
or written representations or statements made by the Releasees with respect to the
safety of ATV Activities. You also agree that any interpretation of these terms
and / or this disclaimer shall be made in accordance with the laws of Wisconsin
and any litigation shall be brought in the state of Wisconsin.
By registering with North East Wisconsin Riders Inc.,
or by participating in, or by observing ATV Activities, you hereby state that you
meet the above criteria and agree to abide by all of the above rules and policies.
You, the registered, do hereby acknowledge receipt of a copy of,
and agree to abide by, all North East Wisconsin Riders Inc. rules and regulation,
I also acknowledge the risk of injury to my person or property and to others while
riding, patrolling, practicing or competing on all North East Wisconsin Riders Inc.
authorized property. I know and understand that off road riding can be dangerous,
and I will rely on my own judgment and ability and assume all risk of injury or
damage while on North East Wisconsin Riders Inc. authorized property and/or during
club events. I will not file suit against North East Wisconsin Riders Inc.,
its officers, directors, its members or the landowners associated with this club.
